Mediation
What is mediation?
Mediation is a voluntary structured process facilitating negotiation between the parties of a dispute or conflict, with the goal of reaching a realistic and constructive agreement, which both parties may live with comfortably.

How does it work?
Parties provide ‘consent’ to mediate and are interviewed separately prior to the mediation. The issues for mediation are identified and both parties are seen together in an extended session to settle the dispute or conflict.

The main steps in mediation are:

  • Engagement of the mediator
  • Separate meetings
  • Mediation Meeting
  • Agreements Verbally Confirmed
  • Written Agreement Confirmation
  • Follow-up

When is mediation not appropriate?

  • When there is power imbalance between the parties, which prevents fair negotiation.
  • When one or both parties do not provide consent to mediate
  • When a serious breach of conduct occurs
